Terms of Service — CollectViz

1. Acceptance

By creating an account or using CollectViz ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

CollectViz provides portfolio analytics and decision support for collectors of trading cards and sealed product. The Service includes data import, cloud sync, AI-assisted research, and related features. Available features may change without notice.

3. Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
You are responsible for safeguarding your password and any actions taken under your account.
You agree to provide accurate information and to keep your contact email current.
We may suspend or terminate accounts that violate these Terms or that are used in ways that harm the Service or other users.

4. Your data

You retain ownership of the collection data and CSV imports you upload. You grant CollectViz a limited license to store, process, and display that data solely to provide the Service to you. We do not sell your collection data. Data handling is described in the Privacy Policy.

5. AI-assisted features

Some features use third-party AI providers to generate research and decision support. AI output is informational, may be inaccurate, and is not financial advice. You are responsible for any decisions you make based on AI output.

CollectViz currently uses OpenAI (via the OpenAI API) as its sole AI provider for deep research, leaderboard opportunity reads, set/product memos, and the Ask CollectViz AI feature. If additional providers are introduced, this section will be updated and material changes will be notified per Section 11.

6. Acceptable use

Do not attempt to circumvent rate limits, access controls, or billing.
Do not use the Service to violate any law or third-party right.
Do not reverse-engineer the Service or scrape data not belonging to you.
Do not upload data you do not have the right to upload.

7. Subscriptions and billing

CollectViz is currently in private beta. No charges are assessed and no payment information is collected. The following terms will take effect when paid plans launch and you opt into one.

Plans. CollectViz expects to offer a Free tier (local CSV dashboard, limited cloud snapshots, basic inventory, cached dossiers) and one or more paid tiers (unlimited cloud history, email auto-import, AI deep research, live market intelligence, higher quotas). Exact features per tier will be listed at the time of launch on the pricing page.
Billing cadence. Paid plans will be billed monthly or annually in advance, in U.S. dollars, through our payment processor Stripe, Inc. Stripe's terms and privacy policy govern card processing.
Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled before renewal. By subscribing, you authorize CollectViz (through Stripe) to charge your payment method on each renewal date.
Cancellation. You may cancel at any time from Settings → Subscription. Cancellation takes effect at the end of the current billing period; you keep access until then.
Refunds. Fees are generally non-refundable. We do not pro-rate partial-period cancellations. Where mandatory consumer-protection law (e.g., EU/UK right of withdrawal) requires a refund, that law controls.
Taxes. Prices exclude applicable taxes (sales, VAT, GST), which will be added at checkout where required.
Price changes. We may change prices with at least 30 days' notice before your next renewal. If you do not agree, you may cancel before the renewal date.
Failed payment. If a charge fails, we may retry, downgrade your plan to Free, or suspend paid features after a reasonable cure period.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that the data, AI output, or analytics will be accurate or suitable for your purposes. Nothing in the Service is financial, investment, tax, or legal advice.

9. Limitation of liability

To the maximum extent permitted by law, CollectViz and its operators are not liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, lost goodwill, lost collection value, or business interruption arising out of or related to the Service.

CollectViz's total aggregate liability arising out of or related to the Service, whether in contract, tort, or any other legal theory, will not exceed the greater of (a) one hundred U.S. dollars (US$100), or (b) the total amount you paid to CollectViz for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in this Section limits liability that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under mandatory law of your jurisdiction. 10. Termination

You may close your account at any time from Settings. We may suspend or terminate access for violations of these Terms. On termination, you may export your data for a reasonable period (see Privacy Policy).

11. Changes

We may update these Terms. Material changes will be notified by email to your account address or by in-app notice at least 30 days in advance of taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may close your account before the effective date.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Binding arbitration. Except for disputes that qualify for small-claims court, any dispute arising out of or relating to these Terms or the Service that the parties cannot resolve informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in California or by videoconference. The arbitrator's decision will be final and binding, subject to any right of appeal under the AAA Rules. Either party may seek emergency equitable relief in court pending arbitration.

Class action waiver. All disputes must be brought in your individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding. If this waiver is found unenforceable as to a particular claim or remedy, that claim or remedy will be severed and pursued in court, with all other claims remaining in arbitration.

13. Trademarks and third-party content

“CollectViz” and the CollectViz logo are trademarks of CollectViz. All other product names, brand names, set names, character names, and trademarks shown in the Service — including Pokémon®, Pokémon TCG, set logos, card artwork, and the names and logos of grading companies, marketplaces, and data providers — are the property of their respective owners. Reference to these names and marks is solely to identify products you may own or research and does not imply endorsement, sponsorship, or affiliation. CollectViz is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Creatures Inc., Game Freak, PSA, CGC, TCGplayer, PriceCharting, or any other third party whose data, imagery, or brand may appear in the Service.
